terms & conditions for content creator application

A. Ageism Is Never In Style (AINIS) is a trading name of The Bias Cut Limited (Bias Cut) and in this document the words ‘we’, ‘us’ and ‘ourselves’ include both AINIS and Bias Cut. AINIS is also a registered trademark and wordmark.

 

B. Through the Ageism Is Never In Style website (AINIS Website) we make available a number of services and features. These include the Ageism Is Never In Style Content Creator and Influencer Network ( the Network).

C. If you have signed up to our Network and /or apply for the opportunity to create content for our upcoming early 2025 campaign with AJ Bell Money Matters (M M Campaign), you agree that the following Terms and Conditions (the Terms) apply.  If you do not wish to accept any of the Terms you should not apply.

The Terms:

​

(1) When you apply for the opportunity to create content for the M M Campaign, you are entered onto our database to receive details and updates regarding that campaign. Our Privacy Policy applies.

​

(2) We do not guarantee that the M M Campaign opportunity is appropriate for you and we are not liable to you in any way for any failure to notify you of any further or related opportunity that would interest you. We are not liable should we change the terms and conditions of this or any other opportunity, cancel or withdraw this or any other opportunity, change the requirements of this or any other opportunity and/or the date(s) required for applying and/or participating in this or any other opportunity.

(3) In notifying you of this opportunity to be involved in the M M Campaign we are not acting as your agent nor the agent of any third party with which an opportunity arises. We have a contract with A J Bell Business Solutions Limited (AJ Bell) and, if you are selected and accept the opportunity to create content for the M M Campaign, we shall enter into a contract directly with you to provide those services to us for supply to A J Bell.

(4) We are not liable in any way for the outcome or consequences of our notifying you of this opportunity or of your applying for or accepting it if offered or for your not being selected to create content for the M M Campaign. We are not liable for any harm or other damage arising as a result of our supplying to A J Bell the content you create for us in the event that you are selected and accept.

​

(5). We have total discretion to select whomsoever we deem appropriate to create content for our M M Campaign and without explanation as to our choice. We  have complete discretion to change our decision as to who will create content for the M M Campaign at any time before we have signed a contract with an individual to create content for the M M Campaign and shall not be liable for the consequences of our changing our decision.

(6) If we shortlist you for the role of content creator for the M M Campaign you must be available for and attend an online video call the week of 25th November 2024. You must keep confidential all Confidential Information relating to ourselves or A J Bell and the M M Campaign discussed in this video call.

 

(7) If we select you for the role of content creator for the M M Camapign, you must be available for an online video call to finalise the content in order to submit the final content to us by Friday 20th December 2024 at the very latest.  If you fail to attend that call we may terminate our contract with you with immediate effect and offer the role to another individual.

 

(8) If we select you for the role of content creator for the M M Campaign and you accept you will be required to sign a contract with us for provision of your services to the M M Campaign. That contract will include, but not be limited to, the following terms:

    (a) You will be paid a one off fee of £300, excluding VAT, for creating content for the M M Campaign. You will not be        reimbursed for any costs or expenses incurred in connection with creating content for the M M Campaign.

    (b)  The content you create for the M M Campaign (Your Content) will be a one off piece of work and we shall not be under any obligation to contract with you for any other work.

     (c) Your Content will be a video reel of up to 1 minutes 30 seconds, to be featured and shared across the AINIS, AJ Bell Money Matters and your own social media channels.

     (d) You will retain intellectual property rights to Your Content but you will grant both Bias Cut and A J Bell each an exclusive non-transferable ongoing royalty free license to use Your Content for the purposes of the M M Campaign.

     (e) Your Content cannot be used for any other purpose than the M M Campaign, and whenever sharing or promoting Your Content you must credit each of AINIS , A J Bell and the M M Campaign

     (f) Your Content must not infringe the intellectual property rights of any person or third party and you alone will be responsible for the consequences if it does so. You are responsible for ensuring all consents, licences and permissions required to meet your obligations under the contract are obtained.

      (g) You shall keep confidential all Confidential Information relating to ourselves or A J Bell and the M M Campaign and not use any Confidential Information other than for the purposes of performing your obligations in respect of the M M Campaign.​

     (h) You warrant that you are suitably skilled and experienced to perform the services required under the contract and will perform them with the highest level of care, skill and diligence.

(9) Application for this opportunity is open to individuals, with or without an agent, but it is not open to professional agents, agencies, organisations or companies. Application is open to those with agents, but must be submitted individually as   we cannot accept applications via agents, and we cannot enter into any contractual agreement with an agent on an applicant’s behalf. If you have an agent you are solely responsible for ensuring that by applying to us directly you are not infringing or breaching the terms of your agreement with your agent and are solely responsible for any consequences of infringing or breaching that agreement. We shall not pay any additional agency fees or sums if you are selected and have an agent.

(10) The Terms shall be governed by and construed in accordance with the laws of England and Wales.
