terms & conditions for content creator application

A. Ageism Is Never In Style (AINIS) is a trading name of The Bias Cut Limited (Bias Cut) and in this document the words ‘we’, ‘us’ and ‘ourselves’ include both AINIS and Bias Cut. AINIS is also a registered trademark and wordmark.

 

B. We make available a number of services and features through the Ageism Is Never In Style website (AINIS Website). These include the Ageism Is Never In Style Content Creator and Influencer Network (the Network).

C. Made of More (MOM) is a trading name of Formosa Wellbeing Limited. If you have signed up to our Network and /or apply for the opportunity to create content for our upcoming collaboration with MOM (MOM Collaboration), you agree that the following Terms and Conditions (the Terms) apply.  If you do not wish to accept any of the Terms you should not apply.

The Terms:

GENERAL

​

1. When you apply for the opportunity to create content for the MOM Collaboration, you are entered onto our database to receive details and updates regarding this. Our Privacy Policy applies.

​

2. We do not guarantee that an opportunity with the MOM Collaboration is appropriate for you and we are not liable for any failure to notify you of any other opportunity that would interest you. We may change the terms and conditions of this or any other opportunity, cancel or withdraw this or any other opportunity, change the requirements of this or any other opportunity and/or the date(s) required for applying and/or participating in this or any other opportunity. We are not liable for the consequences of our doing so.

3.  In notifying you of this opportunity we are not acting as your agent or the agent of any third party with which an opportunity arises. We have a contract with MOM and all the details in any application you submit to us for consideration as a content creator for the MOM Collaboration will be provided to MOM.  MOM’s privacy policy will apply.

 

4.  We are not liable in any way for the outcome or consequences of our notifying you of this opportunity to create content for the MOM Collaboration or of your applying for or accepting a content creator role if offered, or for your not being selected to create content for the MOM Collaboration.

 

5. Application for this opportunity is open to UK resident individuals ONLY , with or without an agent, but it is not open to professional agents, agencies, organisations or companies. Application is open to UK resident individuals with agents, but must be submitted individually as we cannot accept applications via agents, and we cannot enter into any contractual agreement with an agent on an applicant’s behalf. If you have an agent you are solely responsible for ensuring that by applying to us directly you are not infringing or breaching the terms of your agreement with your agent and are solely responsible for any consequences of infringing or breaching that agreement. We shall not pay any additional agency fees or sums if you are selected and have an agent.

MOM’s SELECTED CONTENT CREATORS

6.1 MOM will select the applicants it wishes to consider to create content on its behalf for the MOM Collaboration. MOM has total discretion as to whom it selects.  Neither we nor MOM will provide an explanation of why an applicant has or has not been selected.

 

6.2  If you are chosen by MOM  to take part in the MOM Collaboration and you wish to accept, MOM will ask you to enter into a contract directly with it to provide your services.  MOM’s contract may include, but shall not be limited to, the following terms:

​

    (a) that you will provide MOM with speaking to camera content of at least 2 minutes long in total.  This should consist of  talking about MOM’s 4 core skincare products and/or streamlined skincare routine, including hooks and call to action, as required by MOM.   (MOM will provide examples and guidance on this).

    (b) that you will grant MOM a non-transferable ongoing royalty free license to use for commercial and advertising purposes any of the reels and recordings you provide to it.

    (c) that you agree to whitelist your Instagram account for paid promotional use; and

    (d) that if relevant you may post the content you create for MOM on your social media channels. (MOM may be happy to collaborate with you on the post.)

  

6.3    In consideration of your creating content for MOM that is used in the MOM Collaboration, you will receive a selection of MOM products. No monetary alternative is available unless MOM considers, at its complete discretion, that you have an appropriately large social media following.  You will not be reimbursed for any costs or expenses incurred in connection with creating content for the MOM Collaboration.

 

6.4 MOM may withdraw any offer to you to take part in the MOM Collaboration at any time before you sign its contract and neither we nor MOM shall be liable for the consequences of it doing so.

 

AINIS’ SELECTED CONTENT CREATOR

7.1 AINIS will select one applicant to create content for AINIS for the MOM Collaboration. We have total discretion as to whom we deem appropriate to create content for us and without explanation as to our choice. 

​

7.2  If we select you to be our content creator for the MOM Collaboration and you wish to accept it, you will be required to sign a contract with us for provision of your services. We may withdraw any offer to you to be our content creator at any time before you sign our contract and without explanation or liability for the consequences of withdrawing our offer.

 

7.3 If selected you must also be available for an online video call to finalise the content in order to submit the final content to us by Friday 5th September  2025 at the very latest.  If you fail to attend that call we may terminate our contract with you with immediate effect and offer the role to another individual.

 

7.4 The contract we require you to sign with us if we select you to create content for AINIS for the MOM Collaboration will include, but not be limited to, the following terms:

    (a)   For creating content for AINIS for the MOM Collaboration (Your Content) you will be paid a one off fee of £350, excluding VAT, and receive a selection of MOM products.   You will not be reimbursed for any costs or expenses incurred in connection with creating Your Content.

    (b) Your Content will be a one off piece of work consisting of a video reel of up to 1 minutes 30 seconds, to be featured and shared across the AINIS  social media channels. You must also share Your Content across your own social media channels and it may be boosted by MOM and/or AINIS , but it cannot be used for any other purpose not provided in these Terms.

     (c) AINIS will own the intellectual property rights in Your Content and will grant MOM an exclusive non-transferable ongoing royalty free license to use Your Content for the purposes of the MOM Collaboration through paid advertising on social media.

    (d) Your Content must not infringe the intellectual property rights of any person or third party and you alone will be responsible for the consequences if it does so. You are responsible for ensuring all consents, licences and permissions required to meet your obligations under the contract are obtained.

      (e) You will keep confidential all Confidential Information relating to AINIS or MOM and the MOM Collaboration and not use any Confidential Information other than for the purposes of performing your obligations in respect of the MOM Collaboration.​

     (f) You warrant that you are suitably skilled and experienced to perform the services required under the contract and will perform them with the highest level of care, skill and diligence.

 

   GOVERNING LAW

  8.  The Terms shall be governed by and construed in accordance with the laws of England and Wales.
